DePuy (LCS Duofix™ Femoral Component) class
action
On 29 August 2012, a provisional settlement of the DePuy knee
implants class action was reached. On 3 December 2012, the
settlement was approved by the Federal Court of Australia.
The class action was commenced in March 2010 by Pamela Casey on
behalf of all patients (known in the class action as 'Group
Members') who were surgically implanted with a DePuy LCS Duofix
Femoral Component in Australia.
On 3 September 2012, the Federal Court directed that a Settlement Notice be provided to
Group Members. A copy of the Settlement Notice can also be
downloaded under the box titled 'Settlement Documents' at the top
left corner of this webpage.
As a result of the Federal Court's approval of the settlement,
Group Members can now make individual claims for compensation under
the settlement of the class action.
What are LCS® Duofix™ Femoral Components?
The DePuy LCS Duofix Femoral Component is a knee implant that
was manufactured by a UK based company, DePuy International
Limited, and distributed within Australia by Johnson & Johnson
Medical Pty Limited. In July 2009, DePuy and Johnson & Johnson
conducted a voluntary recall of the LCS Duofix Femoral Component in
consultation with the Therapeutic Goods Administration.

Settlement of the class action
Details of the settlement are contained in the Settlement Notice, which contains
important information regarding the settlement and what Group
Members need to do to make a compensation claim under the
settlement.
As a result of the orders made by the Federal Court on 3
December 2012, a Liability Protocol and a Compensation Protocol
will be used to assess individual claims for compensation by Group
Members.
