Josh's experience includes:

  • negotiating a seven-figure settlement of a dispute over an unpaid bonus for an executive of a well known Australian company without needing to commence court proceedings
  • acting for the government agency, the Fair Work Ombudsman, in its prosecution of an employer who failed to offer a suitable position for an employee who was returning to work from maternity leave
  • obtaining a seven figure settlement for a senior, long serving employee, after urgent court action was taken to prevent his employment being unlawfully terminated
  • negotiating an enhanced termination package for the CFO of a listed company after inititating proceedings alleging 'adverse action' under the Fair Work Act 2009 (Cth)
  • successfully representing one of Victoria's highest ranking police officers, Peter de Santo, in Supreme Court defamation proceedings against the publishers of "Snouts in the Trough" by Andrew Fraser resulting in payment of compensation and the publication of a full public apology and retraction given on 25 March 2011
  • representing two women air traffic controllers in Federal Court proceedings who allege prolonged sex discrimination and severe workplace bullying at Airservices Australia. Click here to read more
  • representing the Australian Workers Union and the family of Larry Knight in the investigation and coronial inquest into the Beaconsfield mine collapse between 2006-2009. Click here to read more
  • representing the ACTU and 12 Ansett trade unions in the ground-breaking insolvency and superannuation fund litigation in the Federal Court between 2002 and 2006 following the collapse of Ansett.
  • successfully representing The Wilderness Society in proceedings brought against it and other defendants by Gunns Limited in the Supreme Court of Victoria. Those proceedings were resolved on 18 March 2009 with Gunns agreeing to make a net payment to The Wilderness Society of $325,000. Click here to read more
  • obtaining Court orders overturning outsourcing, including reinstatement and compensation for over 50 employees in ASU v Greater Dandenong City Council (2001)
  • successfully representing the MUA in the Federal Court and High Court against Patrick Stevedores and the Federal Government during the 1998 Waterfront dispute
  • writing numerous papers on employment related topics, including workplace bullying.
