VW Audi Skoda class action underway in Federal Court

26 November 2015
Australia’s largest and most successful class action law firm, Maurice Blackburn Lawyers, has welcomed two crucial developments ordered by Justice Foster in today’s first case management hearing for the Australian consumer class actions against Volkswagen, Audi and Skoda.

Maurice Blackburn Principal Jason Geisker said Justice Foster had quickly made his intentions clear in how he wanted to deal with the case, by ordering the Volkswagen, Skoda and Audi international parent companies to cooperate and participate in a proper fashion, and by ordering that Quinn Emanuel Urquhart & Sullivan be removed from the court record in the competing Bannister claims.

“Maurice Blackburn is the first and only law firm to bring class actions in Australia on behalf of affected Australian motorists against the European manufacturers of these dirty and illegal diesel vehicles,” Mr Geisker said.

“We’re pleased our action is now underway, and we are happy the Court has today given strong directions requiring VW, Skoda and Audi to promptly explain their conduct and indicate which allegations they admit to and which ones they intend to dispute – and explain why.

“It is clear the overseas vehicle manufacturers have serious allegations to answer and obligations to meet.  If they are acting in the best interests of their Australian customers now they should promptly acknowledge the claims of over 90,000 motorists and respond to the Court’s processes.

“The parent manufacturing companies joined in the Volkswagen, Audi and Skoda cases have been invited by the Court and Maurice Blackburn to voluntarily participate in this process. We expect these parent companies to honour their CEO’s promise, to do everything necessary in order to reverse the damage this scandal has caused to motorists, by promptly appointing local representatives to ensure they right the wrongs done to all affected motorists.

“Victims of the wrongdoing choosing between the competing class actions are now further assisted with the news that Justice Foster’s first order today was that Quinn Emanuel Urquhart Sullivan be removed from the court record in the Bannister actions.”

For people and businesses yet to sign up to recover losses via the class actions, Maurice Blackburn clearly provides the strongest and most comprehensive chance of success. Registration is simple and open now via the firm’s website www.mauriceblackburn.com.au/volkswagen

“Maurice Blackburn’s no win – no charge action means people have the option of first-rate legal representation without having to give away 25-30 per cent of their entitlements to a third party litigation funder, as they do in the competing Bannister actions,” Mr Geisker said.

“Importantly Maurice Blackburn’s comprehensive claim also ensures that affected motorists have the nation’s leading class actions experts in their corner to take on this multi-national giant in VW.”

The parties are due back in Court on Thursday, 17 December.
