If the claim involves losses sustained by both an insured Claimant and an insurer Claimant at the same loss location, then the loss assessment process will work accordingly:

  • We will collect information from the insurer Claimant about the losses sustained at the loss location and the insurance payments made to the insured Claimant. This information will be provided to the loss assessor.
  • Location specific information, including information used to calculate the Flood Adjustment Factor, will be provided by the insured Claimant.
  • The overall loss assessment will consider both the insurer Claimant’s losses as well as any losses that were not covered by the insurance. The insured losses will be paid to the insurer Claimant, and any further losses will be adjusted and paid to the insured Claimant.

Some claims may involve losses sustained by an insurer Claimant but where the insured person did not register to participate in the class action. In these circumstances, we will invite the insured person to register as long as their contact details have previously been provided to Omni Bridgeway. If the insured person registers before the relevant deadline, they will become entitled to participate in the Settlement Scheme.
