The class action alleges that the JB Hi-Fi extended warranties were of little or no value because customers already had the same rights for free under the Australian Consumer Law. 

Compensation is claimed for everyone who bought an extended warranty from JB Hi-Fi between 1 January 2011 and 8 December 2023. People who are part of the class action are called ‘Group Members’.

Are you a Group Member in the JB Hi-Fi Class Action?

You are Group Member in the JB Hi-Fi Class Action if you bought an extended warranty (also known as Customer Care, Extended Care and Extra Care) from JB Hi-Fi in-store or online in Australia any time between 1 January 2011 and 8 December 2023.

You are a Group Member even if you have made a claim under the warranty or if your warranty has expired.

Do I need to register to be part of the JB Hi-Fi Class Action?

By registering you will receive updates about the case, and we will tell you if and when you need to do anything to claim compensation money. You need to register to get these updates, but you don’t need to register to be a Group member, if you meet the description above you are already part of the class action.

What is the JB Hi-Fi Class Action about?

JB Hi-Fi customers have the option to purchase an extended warranty on products including electronic devices, home entertainment and home appliances.  

JB Hi-Fi has sold the extended warranties in its stores and online since at least 1 January 2011. During that time the extended warranties have also been called Customer Care, Extended Care or Extra Care.

The class action alleges that these extended warranties had little to no value to JB Hi-Fi’s customers, because the Australian Consumer Law already gives them the same (and often better) rights to have their goods repaired, replaced, or refunded if they are faulty, without paying for an extended warranty.

This class action seeks compensation for Group Members from JB Hi-Fi.

Court and legal claims

The class action is being conducted in the Supreme Court of Victoria. 

It alleges that JB Hi-Fi used misleading or deceptive conduct or unconscionable conduct in selling the extended warranties, including by telling customers either directly or by implying, that the extended warranties:

  • operated for longer than the rights under the Australian Consumer Law;
  • provided benefits that the Australian Consumer Law did not; and
  • were of value to customers.

JB Hi-Fi also failed to give customers important information about their rights under the Australian Consumer Law, which they needed to make a properly informed decision about whether to buy an extended warranty.

The class action also alleges that for all of these reasons, the JB Hi-Fi customers bought the extended warranties on the basis of a mistake about their value.

Frequently Asked Questions about the JB Hi-Fi Class Action

No. It will not cost you anything to be part of the class action and you will never be asked to pay any costs out of your own pocket.

Group members will not be asked to pay anything upfront. The case is set up so that group members will never be out of pocket.

Costs will only be payable if:

  1.  the case is settled - meaning JB Hi-Fi agrees to pay compensation without needing a trial; or
  2.  there is a trial and we win the case.

Court orders are needed for any payments to be made to Maurice Blackburn.

We are not able to predict how much compensation money group members may receive. It is likely to be different from person to person, depending on the number and price of extended warranties they purchased.

Class actions usually take between 2 and 4 years. They are very hard fought because the stakes are high.

The length of the JB Hi-Fi Class Action will depend on many factors, including how JB Hi-Fi responds to the case.

The Australian Competition and Consumer Commission (ACCC) defines an extended warranty as “an optional promise that a person or business makes when selling a product that specifically extends the length of the manufacturer’s warranty”.

Products that JB Hi-Fi sold as extended warranties have also been called Extended Care, Extra Care, Customer Care or Warranty Extensions at different times since 1 January 2011. In the JB Hi-Fi Class Action we are saying that these were of little or no value because consumers already have the same rights for free under the Australian Consumer Law.

The class action is claiming compensation for all of the extended warranties you bought from JB Hi-Fi between 1 January 2011 and 8 December 2023.

If you register, there is an option to enter information about more than one extended warranty. You are not required to provide this information to register.   

Yes, you are part of the class action even if you claimed on your extended warranty, as long as you were not refunded the full cost of the extended warranty.

If you bought your extended warranty from JB Hi-Fi between 1 January 2011 and 8 December 2023 you are part of the class action, even if your extended warranty has expired.

Unfortunately, you are not eligible to be part of this class action if you bought your extended warranty before 1 January 2011. This is because the law the case is based on, the Australian Consumer Law, did not come into effect until 1 January 2011.  

No. This class action is only about extended warranties JB Hi-Fi sold to customers.

Please note: We may not be able to get records from JB Hi-Fi of extended warranties bought before 8 December 2016. JB Hi-Fi may not have these records because companies are only legally required to keep business records for 7 years.  

If you think you have bought an extended warranty from JB Hi-Fi between the 1 January 2011 and 8 December 2023 but don’t have any receipts or documents for it, we encourage you to register your interest.

You can ask JB Hi-Fi to check if you have bought an extended warranty from them.

During the legal process Maurice Blackburn may be able to confirm who bought extended warranties from JB Hi-Fi in the relevant period through the company’s records. 

Please note: We may not be able to get records from JB Hi-Fi of extended warranties bought before 8 December 2016. JB Hi-Fi may not have these records because companies are only legally required to keep business records for 7 years.  

This class action does not include JB Hi-Fi’s Mobile Extras plans because they are different to extended warranties. 

The legal claims in the class action do not apply to the Mobile Extras plans, so they can’t be included in the class action.  

This class action is against JB Hi-Fi, so it is limited to extended warranties bought from JB Hi-Fi, either in-store or online. 

The ACCC states that “Consumers have the right to expect certain things when they buy a product or service… Consumers are entitled to a solution of a repair, replacement or refund if a product or service they buy doesn’t meet one of the basic rights”.
