Types of road accident claims we handle

No two road accidents are the same. The type of vehicle, where the accident happened, and how badly you were injured will all affect your claim. We handle the full range of motor vehicle accident compensation claims, including:

If you have sustained physical or emotional trauma or lost someone you depended on in a car accident, you may be entitled to compensation for medical treatment, lost income, reduced earning capacity and lump sum payments.

Motorcyclists, scooter riders and pillion passengers face higher risks of  severe and catastrophic injury. We help injured riders and families of fatal accident victims pursue the compensation they’re entitled to.

If you’ve been injured cycling on a road, bike path or shared space, or lost  someone you were dependent on in a collision involving a motor vehicle, we can help you claim compensation.

E-scooter injuries are rising fast. Accidents may involve cars, pedestrians, poorly maintained roads or faulty scooters. If you were injured riding an e-scooter, or hit by one, you may have a compensation claim.

If you’ve been injured while travelling in an Uber, taxi or other rideshare service, you may still be entitled to compensation, whether the crash was caused by the rideshare driver, another vehicle or road conditions.

Quad bikes are the leading cause of serious injury and death, particularly in rural and farm settings. If you have been hurt riding a quad bike or someone you were dependent on is fatally injured, we can help you access compensation.

Accidents involving heavy vehicles are among the most serious on Australian roads. If you've been injured in a collision with a truck or other heavy vehicle, our motor vehicle accident lawyers can advise you on your rights. We have dedicated truck accident lawyers in Queensland and Perth.

Whiplash is common in rear‑end collisions and can become chronic. Serious whiplash injuries may qualify for common law compensation, depending on medical evidence and how the injury affects your life.

What are the different types of road accident compensation?

Statutory benefits may be provided through your state’s compensation scheme (TAC in Victoria or CTP elsewhere) and in some states are generally available regardless of who was at fault. These benefits can cover medical and rehabilitation costs, income support and, in serious cases, lump sum payments.

If someone else’s negligence caused your injuries and you meet the required threshold, a common law claim may allow you to seek compensation for pain and suffering, lost income and earning capacity, medical and rehabilitation expenses, and care and assistance needs.

Even if you were partly at fault, you may still be entitled to compensation. We’ll assess your situation and give you clear, honest advice.

How to make a motor vehicle accident claim

If you’ve been injured in a road accident, your health comes first. Seek medical treatment as soon as possible, even if your injuries seem minor.

If police did not attend the scene, you should also report the accident to police before making a claim. Police reports are often essential to protect your legal rights. If you haven’t done this yet, we can help.

Once that’s done, the claim process generally involves:

Speak with an experienced road injury lawyer. We’ll assess your claim, explain your options and discuss fees, with no obligation.

Claims involve detailed forms and strict requirements. We’ll help prepare and submit everything correctly.

We collect medical records, witness details and other evidence needed to build a strong case.

Independent medical examinations may be required to assess how your injuries affect your work and daily life. We organise these for you.

We manage your claim from start to finish, keeping you informed. If court action is needed, we’ll guide you through that too.

How motor vehicle accident compensation works

What compensation can provide:

Medical and rehabilitation costs, lost income and superannuation, care and support needs, and in some cases lump sum compensation. In fatal accidents, death benefits and dependency claims may apply.

Time limits:

Strict deadlines apply and vary by state and by age. Some claims must be lodged within 28 days, so early legal advice is critical.

Fees and costs:

We offer No Win, No Fee legal support. Your first consultation is free, and if you don’t proceed, you don’t pay.

Frequently asked questions about motor vehicle accident claims

What you do in the moments and days after a road accident matters for your health and for your claim. If you can, take these steps:

  • get medical help straight away, even if injuries seem minor
  • exchange details with other drivers (name, contact details, registration and insurer)
  • take photos or videos of vehicles, injuries, road and weather conditions, and the accident location
  • get witness details if anyone saw what happened
  • report the accident to the police if they did not attend the scene, as most insurers will not accept a road accident injury claim without a police report
  • keep all medical records, receipts and correspondence from this point forward
  • report the accident to the relevant insurer or authority as soon as possible
  • seek legal advice early to understand your rights and time limits

In some states, time limits can be as short as 28 days. Getting early legal advice can make all the difference.

Road accident injuries aren’t always clear straight away. Some take weeks or months to fully reveal how serious they are. Compensation may be available for injuries including:

  • back injuries and spinal damage
  • brain damage or traumatic brain injuries (TBI)
  • injuries involving an amputation
  • neck injuries
  • soft tissue spinal injuries
  • head injuries
  • whiplash
  • broken bones
  • chronic pain
  • psychological trauma (such as post-traumatic stress disorder)

What you can claim depends on how serious your injuries are and how they affect your life, work and recovery. An experienced road accident lawyer can help you understand what you may be entitled to now, and in the long term.

Road accident compensation is designed to cover the reasonable costs of your injury and recovery. What’s included depends on your state and the scheme you’re covered by, but may include:

  • medical and hospital treatment, including medication and counselling
  • rehabilitation and therapy
  • nursing, disability services, and post-acute support services
  • expenses arising from a death including funeral costs.
  • Travel to medical appointments
  • Help returning to work or retraining
  • Home and vehicle modifications
  • Attendant care and home help, such as domestic assistance or tutoring
  • Funeral expenses and related costs in fatal accidents

In some states, you may have common law rights against the person who caused the accident. These claims can provide compensation for:

  • pain and suffering
  • past and future medical expenses
  • past and future loss of income
  • loss of earning capacity and superannuation
  • care and assistance

There’s no one‑size‑fits‑all answer. Your compensation depends on how serious your injuries are, when the accident happened, and which law or scheme applies to your claim.

Our role is to make sure nothing is left on the table. A road accident lawyer can assess your situation, explain what you may be entitled to, and give you a clear picture of what your claim could be worth based on the facts, not guesswork.

We work on a No Win, No Fee basis. That means if we don’t win your claim, you don’t pay your legal fees.

What it costs if you do proceed depends on how complex your claim is and how much work is required. In some cases, the insurer may also be required to cover part of your legal costs. We’ll explain all fees clearly before you sign anything, so there are no surprises.

Your first consultation is free. Call us to find out where you stand.

You can represent yourself, but most people choose not to. Road accident claims involve strict rules, deadlines and insurers whose job is to minimise what they pay out.

Without a lawyer, you’re expected to understand the law, manage the claim, negotiate with insurers and make sure nothing is missed. Self‑represented claimants are often offered lower settlements, simply because they don’t know what they’re entitled to.

An experienced road accident lawyer levels the playing field and helps protect your full compensation.

Most road accident claims take around 1 to 3 years, depending on how serious your injuries are and how long they take to stabilise.

While we need to understand the long‑term impact of your injuries before finalising compensation, we work to move your claim forward as efficiently as possible and can often secure early funding for treatment and support while your claim is ongoing.

We’ll give you a clear idea of what to expect based on your situation, not vague promises.

Motor vehicle accidents cause serious harm on Australian roads each year, with around 1,200 lives lost and tens of thousands of people seriously injured. Many crashes are preventable. Some of the most common causes include:

Distracted driving
This is one of the leading causes of road accidents and includes using a mobile phone, eating or drinking, adjusting GPS or vehicle controls, or not paying full attention to the road.

Speeding
Driving over the speed limit reduces reaction time and increases the severity of crashes, particularly in poor weather or heavy traffic.

Impaired driving
Alcohol and drugs significantly affect judgement and reaction time. Driving while impaired remains a leading cause of serious and fatal road accidents.

If you’ve been injured in a road accident, whether you were at fault or not, our experienced road accident lawyers can advise you on which compensation scheme applies and what you may be entitled to claim.

Types of motor vehicle accident claims by state

The road accident compensation you may be eligible for will vary depending on which state your accident happened, and where your vehicle is registered. Each state and territory has different laws, road accident schemes and compensation claim processes.
