Maurice Blackburn is conducting a class action against JB Hi-Fi Group Pty Ltd (JB Hi-Fi) related to extended warranties.
JB Hi-Fi customers have the option to purchase an extended warranty on products including electronic devices, home entertainment and home appliances.
JB Hi-Fi has sold the extended warranties in its stores and online since at least 1 January 2011. During that time the extended warranties have also been called Extended Care or Extra Care.
The class action alleges that these extended warranties had little to no value to JB Hi-Fi’s customers, because the Australian Consumer Law already gives them the same (and often better) rights to have their goods repaired, replaced, or refunded if they are faulty, without paying for an extended warranty.
Compensation is claimed for everyone who bought an extended warranty from JB Hi-Fi between 1 January 2011 and 8 December 2023.
The judge who is case managing the class action, the Honourable Justice Delany, ordered that the initial trial of the class action will begin on 5 October 2026 and will run for an estimated six weeks.
The initial trial in a class action is concerned with the claims made by the lead plaintiff and any sample group members. By running the claims of Mr Clarke (who bought a fridge and an extended warranty in store in 2020), and two sample group members (one who bought a television and extended warranty online in 2023, and one who bought a laptop and extended warranty in store in 2016) the initial trial will answer key legal and factual questions. The Court’s findings on these issues will inform how the remaining claims of group members will be dealt with.
Justice Delany also made orders regarding dates by which important steps must happen, for example filing evidence from lay and expert witnesses which will be relied upon at trial.
Maurice Blackburn will publish regular updates about the class action as they become available.
People who are part of the class action are called ‘Group Members’.
You are Group Member in the JB Hi-Fi Class Action if you bought an extended warranty (also known as Extended Care and Extra Care) from JB Hi-Fi in-store or online in Australia any time between 1 January 2011 and 8 December 2023. You don’t need to register to be part of the class action, but you can register to receive updates about the case, and we will tell you if and when you need to do anything to claim compensation money.
We are running a separate class action about extended warranties known as “Product Care” sold by Harvey Norman, Domayne and Joyce Mayne. Find out more and register for the Harvey Norman class action
The class action is being conducted in the Supreme Court of Victoria.
It alleges that JB Hi-Fi used misleading or deceptive conduct or unconscionable conduct in selling the extended warranties, including by telling customers either directly or by implying, that the extended warranties:
The case also alleges that JB Hi-Fi failed to give customers important information about their rights under the Australian Consumer Law, which they needed to make a properly informed decision about whether to buy an extended warranty.
The class action also alleges that for all of these reasons, the JB Hi-Fi customers bought the extended warranties on the basis of a mistake about their value.
