Motorcycle and scooter riders are a vulnerable group on our roads and unfortunately at higher risk of accidents. We're long-standing advocates of motorcycle riders, particularly via our Stop SMIDSY ("Sorry mate, I didn't see you") campaign pushing for both greater awareness and legislative change.

Making a motorcycle accident claim

If you've been in a motorcycle accident, we can help you with your claim.

Generally speaking, you'll need to:

  • Report the motorcycle or scooter accident to the police. We can help you do this if you haven't already.
  • Get a medical certificate to support your claim, preferably from your own doctor.

Our experienced motorcycle accident lawyers will then fill out and submit a motorcycle accident claim form with the relevant insurer - this will vary depending on what state you're in.

Our lawyers will proactively work to get your rehabilitation costs covered as soon as possible, working closely with your healthcare providers. Our first priority is seeking funding for your treatment so you are not out of pocket and can access the rehab you need for recovery.

If someone you were dependent on is fatally injured in a motor vehicle accident, you may also be eligible for compensation. Our lawyers can help you with your claim.

Types of compensation

Depending on where the motorbike accident happened and how severe the injury is, there are different options available to claim compensation, including:

  • Workers' compensation
  • Road accident compensation
  • Total and Permanent Disability (TPD), part of your superannuation insurance
  • Public liability claim

What can be covered?

The type of benefits you're entitled to can depend on where the motorbike accident happened, and how serious the injuries are. You may be able to claim for expenses including:

  • medical and hospital expenses
  • rehabilitation and post-acute support
  • disability support
  • income support
  • lump sum
  • expenses following death, like funeral costs

Time frame and costs

Most motorcycle accident claims take around 1-3 years to complete, but this will depend on whether the insurer accepts fault and the time taken to be treated for your injuries. We know you want to resolve the matter quickly, and our motorcycle accident compensation lawyers will be able to give you a good indication of how long the claim may take once your injuries have stabilised.

Motorcycle accident claims can be run on a 'no win, no fee' basis, and your first consultation is obligation-free.
