Understanding workers' compensation in Western Australia

WorkCover is the government agency that is responsible for overseeing and regulating the workers’ compensation and injury management scheme in WA.

 

In WA, employers must take out individual workers' compensation policies through various private insurers. These insurance policies are there to protect workers if they’re injured or become sick due to work.

All full time workers, part-time workers, casual employees, sole traders and subcontractors in WA should be covered by a workers' compensation scheme, as all employers should have workers' compensation insurance. If you've been injured at your workplace, in the course of your work, you may be eligible to make a claim through this insurance. 

Workers' compensation covers all 'reasonable' expenses related to your injury or illness, such as:

  • payments for lost wages
  • medical costs such as hospital and nursing 
  • personal, household and occupational expenses
  • doctors and chemists
  • physiotherapy and chiropractic care
  • rehabilitation 
  • ambulance services 
  • attendant care
  • modifications to a home or car
  • home help
  • transportation costs

Workers' compensation is an insurance that is taken out by and paid for by employers. It works by providing financial assistance to workers who have been injured at work, injured as a result of their work, or have experienced mental health problems due to their work.

 

This financial assistance is not paid for by your employer, it is covered by the insurer. It is there to help support injured workers who are no longer able to do their job and earn an income, and who need to pay for medical treatment. It enables workers to claim compensation for expenses, lost income, treatment services and more. It can also provide compensation to workers with any pre-existing condition that has worsened due to their work. 

 

There are many workers' compensation insurers in Western Australia which may cover your workplace and we can assist you in finding out who the relevant insurer is. 

Yes, an insurer can dispute or reject your claim - this typically happens on the basis of liability. If your claim has been rejected by the insurer, you will most likely need to commence an application through the WorkCover WA Conciliation and Arbitration Service to challenge the insurer’s decision. If liability is disputed by the insurer, it's best to seek legal advice to understand your options. 

If your worker's compensation claim has been rejected and you want to dispute this decision, it's best to seek legal advice as soon as possible. 

Under the WA Workers’ Compensation Act, you must lodge a workers’ compensation claim within 12 months of the injury occurring. 

 

In some cases, you can lodge a claim outside of this timeframe. However, any delay in making a claim can be used by the insurer as a further reason to deny the claim, so it is best to lodge the claim as soon as possible. 

How long you'll be able to receive workers' compensation payments for will depend on a number of factors, such as your doctors' recommendations, when you were injured and more. If you go back to work or receive a lump sum, you will stop receiving these payments.
