On 2 February 2023, Maurice Blackburn filed a class action in the Federal Court of Australia against Jaguar Land Rover in relation to certain diesel vehicles. The affected vehicles contain an exhaust filter system, including a DPF, designed to reduce emissions in order to meet Euro 6 emissions standards. 

The class action was commenced on behalf of anyone who acquired (including by way of purchase, exchange, lease or hire-purchase), one or more of the following affected vehicles at any time between 1 July 2015 and 2 February 2023:

Case update

A similar class action was filed by another law firm against Jaguar Land Rover in the Federal Court of Australia (referred to as the “Greentree Proceeding” after the name of the applicants in that class action).

Following a hearing in the Federal Court of Australia about how the two class actions should be managed, the Federal Court ruled that, subject to certain conditions being met, the Greentree Proceeding should continue and the class action commenced by Maurice Blackburn should be stayed (meaning that it should no longer continue).

On 15 November 2023, once the relevant conditions had been met, the Federal Court made orders to the effect that Maurice Blackburn’s proceeding was to be declassed and temporarily stayed pending the outcome of the Greentree Proceeding. As a result of this ruling, the Greentree Proceeding is currently the only class action that is continuing against Jaguar Land Rover in relation to the defective DPF system.

On 23 November 2023, Maurice Blackburn lodged an application to appeal the decision. If the appeal is upheld, Maurice Blackburn will seek orders that the Maurice Blackburn proceeding should continue and the Greentree Proceeding should be stayed.

It is expected that the appeal will be heard in 2024. We will continue to update this page with developments about the appeal process. Until the appeal has been resolved, the Maurice Blackburn proceeding cannot be progressed.

What is the Jaguar Land Rover DPF class action about?

The action alleges that the DPF system is defective as it is prone to become blocked under regular driving conditions. This poses a safety hazard to drivers, passengers, and pedestrians because it can cause the vehicle to lose power suddenly with little to no warning, severely inhibiting the performance and safety of the vehicle on the road. Further, it is alleged that the defective DPF system causes ongoing mechanical issues, reduced fuel efficiency and requires frequent servicing and maintenance. 

The class action alleges that Jaguar Land Rover failed to comply with the guarantee of acceptable quality under the Australia Consumer Law and engaged in misleading and deceptive conduct. 

The class action seeks to recover compensation for loss and damage on behalf of consumers with vehicles affected by the DPF issues. It does not seek to claim for loss or damage which is not related to the DPF system.

Yes, you are eligible to register, even if you have not experienced any difficulties with your DPF system, provided your vehicle is an affected vehicle (set out above) and was purchased or leased between 1 July 2015 and 2 February 2023. 

Yes, you are still eligible to register for the class action if:

  • you no longer own the affected Jaguar or Land Rover vehicle; or
  • you bought an affected vehicle second-hand; or
  • the affected vehicle has been written off or stolen.

At a later stage, we will request more information about your circumstances.

It is too early to predict how much you may ultimately recover.

We will be seeking the maximum recovery available under the law on behalf of group members. 

Signing up to this class action will not expose you to any upfront costs. Unless and until there is a successful outcome, the costs in the proceeding will be borne by Maurice Blackburn and litigation funder, Vannin.

In the event of a successful outcome, any costs payable to Maurice Blackburn and Vannin will be deducted from, and will not exceed, any compensation you are entitled to receive. Importantly, all costs are reviewed and ultimately approved by the Court before being deducted from any compensation you receive. The Court will only approve those costs it considers to be fair and reasonable.
