Understanding workers' compensation in Victoria

Workers’ compensation is an insurance scheme that protects workers if they’re injured or become sick due to work. This insurance is taken out by all employers in Victoria to ensure they're covered if you are injured at work. This means that your employer will not have to personally pay you any money, the compensation that you're entitled to will be paid for by the insurer. 

All full time workers, part-time workers, casual employees, sole traders and subcontractors in Victoria should be covered by a workers' compensation scheme, as all employers should have workers' compensation insurance. If you've been injured at your workplace, in the course of your work, in a recess break, or on a journey to/from work, you may be eligible to make a claim through this insurance. 

Workers' compensation covers all 'reasonable' expenses related to your injury or illness, such as:

  • payments for lost wages
  • medical costs such as hospital and nursing 
  • personal, household and occupational expenses
  • doctors and chemists
  • physiotherapy and chiropractic care
  • rehabilitation 
  • ambulance services 
  • attendant care
  • modifications to a home or car
  • home help
  • transportation costs

Workers' compensation is an insurance that is taken out by and paid for by employers. It works by providing financial assistance to workers who have been injured at work, injured as a result of their work, in a recess break, on a journey to/from work, or have experienced mental health problems due to their work.

 

This compensation is not paid for by your employer, it is covered by the insurer. It is there to help support injured workers who are no longer able to do their job and earn an income, and who need to pay for medical treatment. It enables workers to claim compensation for expenses, lost income, treatment services and more. It can also provide compensation to workers with any pre-existing condition that has worsened due to their work. 

Yes, an employer can dispute a workers' compensation claim. However, they do have strict time limits to do this and must provide sufficient grounds for dispute. A dispute does not necessarily mean that the claim will be rejected, just that a review process will take place. 

If your worker's compensation claim has been rejected and you want to dispute this decision, it's best to seek legal advice as soon as possible. 

Strict time limits can apply. It’s important that you report your work-related injury to both your employer and your workers' compensation insurer as soon as possible. It’s best to do this within 30 days of the incident or once you’ve become aware of your injury or illness.  

How long you'll be able to receive workers' compensation payments for will depend on a number of factors, such as your doctors' recommendations, when you were injured and more. If you go back to work or receive a lump sum, you will stop receiving these payments.
