Maurice Blackburn Associate Amy Williams said the Delaney family had filed proceedings for loss of Carl’s income, as well as compensation for the suffering experienced as a result of Carl’s death.

“Kawasaki Industries and JKC Australia had a duty to provide a safe working environment which they failed to do leading to Carl’s tragic death,” Ms Williams said.

“As a result of Carl’s death Terry and her children had suffered significant psychiatric injuries and have required ongoing treatment for the trauma that this has caused.  

“The INPEX site was notorious for work safety breaches, with these companies repeatedly failing to clean up their act and put worker safety first.

“Unfortunately, Carl’s death is yet another tragic example of lax work health and safety practices leading to the death of a worker in the Northern Territory, with a family left to pick up the pieces.

"Nothing can ever bring Carl back, but Kawasaki Heavy Industries and JKC Australia have a responsibility now to do the right thing in helping the Delaney family to move on with their lives," she said.
